These terms and conditions form part of the contract between you (the customer) and Kake and Cupkakery, please ensure you take the time to read through and also thoroughly check your cake quote as this is the document we work to when completing your order.
We require upto 3 weeks notice for celebration cakes and 3 days notice for cupcake flavour boxes. Kake jars (postal) are posted every Wednesday.
Deposit and final payment
Once you have received your quotation which will include different style cake options as well as different price bands relating to your style and size cake you will be sent an invoice for payment detailing the deposit to be paid and the total cost of the cake. The deposit paid is to secure your date and also contribute to your cake cost as well as cover work already undertaken such as working on your quote and researching designs, therefore your deposit is non-refundable.
A deposit is required within 7 working days from receiving your invoice and no order is confirmed without a deposit being received. A £20.00 non-refundable deposit is required with all celebration cakes or cupcake orders with a value over £30.00 which will then secure your cake order.
If after 7 days of sending your invoice we have not received an order confirmation with a deposit we will assume you no longer wish to proceed with your order and the date you require will then become available for other customers to place orders.
The balance of your cake when paying via electronic methods must be received no later than three working days before your cake delivery day. (The date when the payment is due will be on your invoice) If full payment has not been received by the payment due date your cake order will not be delivered . Please also note we do not accept cash on delivery, payment is by bank transfer only.
Please note: you will have a unique reference number created for your booking, please could you use this reference number in all your correspondence as well as when making payments via bank transfer.
Your cake will be made and decorated as per the description detailed within your cake quote We will not be held responsible for customer disappointment of the design or the interpretation of the cake as long as it is made in line with the customer’s pre agreed requirements set out in the order confirmation and will face no consequent liability. It is the customer’s responsibility to ensure all details within the order confirmation are correct and meet their exact requirements.
We do not take responsibility for your cakes that arise from wilful damage, accident, negligence by you or any third party, also. if you do not store the cake in a way we recommend, your failure to follow our instructions or any alterations you may carry out to the design or structure of the cake.
Our cakes are made in an environment where nuts, egg, milk, gluten and other allergens are present. Therefore our kitchen is NOT a nut free kitchen but every precaution and practicable steps will be made to not cross contaminate cakes with nuts and we will only use if the recipe requires it.
Every cake, cupcake and cake jar ordered is delivered with allergen information but also it is the responsibility of the customer to inform at time of ordering any specific allergies or intolerances
From time to time certain materials for our cakes may become obsolete. This is totally out of our control; however we will do our best to select replacement products to reflect the original design as closely as possible. We reserve the right to replace items with component parts of equal or better quality without consultation.
If your cake contains figures made from sugar paste, whilst edible, we do not advise that they be eaten, due to the possible presence of dowels for reinforcement. All of our figures are handmade, and therefore, whilst we try to capture the characteristics of a particular person if requested (such as with eye colour, hair colour, hair length, glasses etc), we cannot guarantee a true likeness. It is your responsibility to provide images for our reference. If images are not provided standard figures shall be used.
Stacked cakes contain dowels in each tier to provide support and these should be removed before consumption.
The cake is a fresh product containing no additives or preservatives and it is our right to assume consumption on the day requested. Please state which day the Cakes is to be consumed especially if to be delivered at the weekend, we want to ensure that you receive delivery of your cake as close to the consumption date as possible.
All cakes should be stored in a dry place, at room temperature, away from direct sunlight and sources of heat in the box provided. They should not be refrigerated.
If you have any alterations to be made to your cake please let me know as soon as possible. If any alterations are to be made to your cake within the last three days before delivery there is no guarantee that the design can be altered.
If you have not indicated a delivery address at the time of your initial query please be aware that the quote given may incur extra delivery cost.
Your cake will be delivered on the date and time you have specified below to a delivery address of your choosing within the Birmingham area therefore please ensure that there will be a person present at your specified delivery address to accept delivery of your cake/cupcakes at the time agreed
During the Covid-19 pandemic all deliveries will now be contactless
Cakes delivered within a 5 mile radius of B45 will be delivered free, outside of this delivery zone there is a £3.50 delivery charge up to 10 miles, Over 10 miles mileage will be charged at £1.00 per mile.
Postal cake jars are posted the day after the order and payment has been received. To ensure you receive cake jars as fresh as possible all cake jars are sent first class via royal mail and signed for so please ensure that someone is home to receive delivery. We allow 1-2 days for delivery and cannot be held responsible if delivery is beyond the allocated delivery days.
4. Cake stand hire
We do hire out cake stands especially for cupcakes towers but this requires a deposit of £50.00 to be paid and a £5.00 hire charge for the duration of the hire period. Your deposit is returned to you when the cake stand/cupcake stand has been returned or collected undamaged. If you do require the use of a cake stand please state via email when confirming your cake order.
5. Cancellation notice
In the event that your cake order is cancelled for any reason by yourself your deposit will not be returned as this is Non refundable (please see above) if you need to postpone your order your deposit can be moved to a new date (as stated above)
If I am unable to make your cake due to illness or other unforeseen circumstances, you will be notified as soon as possible and you will receive a full refund if your cake has been paid in advance.
If you decide to cancel your cake order and it is on or after the date where the balance of your order is due you will not receive a full refund as work will have been undertaken on your cake. However If the reason for your cancellation is due to a force majeure such as civil unrest, strike or advice from the government relating to national or global issues a percentage of your payment may be returned.
Celebration cakes and cupcakes are made as close to your delivery day as possible to give you the best quality cake as well as allowing adequate time for decoration therefore we will only give a full refund if the cake you receive is incorrect in design. If you are dissatisfied with the quality of your cake it must be returned within 24 hours of delivery along with the reason you are unhappy with the quality/decoration of the cake, after an investigation into your complaint a decision will be made regarding issuing a refund.
After 24 hours Kake and Cupkakery do not accept any liability or will accept any returns regarding design or the quality of the cake delivered.
Postponement of a cake order to a new date is possible. If we can accommodate your new cake delivery date your cake deposit will be moved to your newly chosen delivery date, if however we cannot accommodate your new date due to current bookings a new deposit will be required for your new delivery date.
Every attempt will be made to deliver a cake during inclement weather and if possible arrangements will be made to deliver a cake earlier if the weather (as advised by the Met office) is likely to take a turn for the worse. In the case that it is not possible to safely deliver your cake you will receive a full refund. You may collect if you wish (which will be at your own risk) any delivery cost that has been prepaid will be refunded to you.
Pictures and Social Media
Kake and Cupkakery reserve the right to use pictures of your celebration cake or cupcakes on our website and across social media. Pictures will always be posted the day after your cake has been delivered so please advise if this changes so it is not shared prematurely .No other personal details will be used alongside pictures of your celebration cake or cupcakes. Also I will not post any cakes with personal printed pictures that form part of the cake or cupcake design.
8. How we use your information
From the 25th May 2018 all businesses have to be GDPR compliant
When you complete the contact us form on our website or email us regarding a quote we collect minimal personal information such as your name, address, contact number and email address.
Your personal information given will only be used for the sole purpose of order queries, calculating quotes and delivery of your order.
Your information is securely stored on a password protected device and is not shared with any third party or used as part of any third party digital marketing campaign.
The kake and cupkakery website is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. You currently cannot directly purchase any items from the website but your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.
We may contact you regarding your order request, to collect fees or monies owed, for these purposes we may contact you via the information you have provided either by email, telephone or text messages.
